CHOICE Review

Dean Calabresi (Yale Law School) is clearly one of the sources of the school's reputation as a great teaching institution. The volume before us derives from and in a way is addressed to the dean's students. Student reaction often provides the point of departure for the resolution of a problem in torts laid before the class by one's professor. Despite repeated disclaimers that he is a constitutional law scholar, Calabresi demonstrates how reflection on aspects of technological change, reasonableness, liability,and costs in the law of torts drives one to a consideration of constitutional principles-especially the principles of equity, justice, and the accommodation of conflicting belief systems. Also included in this work is a close look at the decisions in Regents v. Bakke (1978) and Roe v. Wade (1973). The sharply critical discussion of these landmark decisions (especially of the latter one) finds them lacking in persuasive power and perhaps more importantly, in that rhetoric of accommodation that allows losers to accept their loss while retaining their personal dignity as members of our constitutional system. Calabresi has in mind a way of life (the Marshallian Constitution) that permits the most intense conflict among beliefs without threatening the rule of law or the institutional structure within which such a rule can effectively operate.
