CHOICE Review

The purpose of this collection of previously published essays is to delineate the nature, function, and scope of therapeutic jurisprudence. The authors do an admirable job of organizing these disparate pieces into a coherent unit to achieve that purpose. Therapeutic jurisprudence, as defined by Wexler, "is the study of the law as a therapeutic agent. It looks at the law as a social force that, like it or not, may produce therapeutic or antitherapeutic consequences." This definition, in a variety of forms and clarifications, is found in virtually every essay. This form of legal/psychosocial analysis becomes quite clear in Winick's essays on competency to consent to treatment and competency to consent to voluntary hospitalization. Two very useful chapters treat the value of interdisciplinary training in the law and the behavioral sciences and the potential impact of therapeutic jurisprudence as a research tool for mental health law and related areas. The index is short but sufficient, and there is no bibliography, but the extensive and useful footnotes overcome this omission. Recommended primarily for undergraduate schools with substantive pre-law programs and for law schools.-M. A. Foley, Marywood College
