"A bracing work of scholarship that could inspire readers . . . A virtue of Main Currents in American Legal Thought is that Mr. Schwartz continually relates judicial opinions to what was happening in the country."
- "Books of the Times" in the New York Times "A worthy and welcome addition to the literature of American Law. Careful documentation; comprehensive index. Highly recommended for all informed readers."
- Choice "Professor Bernard Schwartz is well know to me and other members of the Supreme Court for the extraordinary range of his scholarship in constitutional law . . .[His] works reflect meticulous research into original sources, an inquiry that is so essential to a clear understanding of the meaning of the constitutional provisions that, in assuring the liberty and dignity of every person, distinguish our governmental system from all others. The quality of Professor Schwartz's work is exemplary."

CHOICE Review

Schwartz (Tulsa College of Law), a noted authority on constitutional and administrative law, has written, in his words, "a legal counterpart" to Vernon Parrington's classic Main Currents in American Thought (1927, 1987). Following Parrington's methodology, Schwartz charts legal history through the ideas of jurists whose contributions helped forge the American legal environment. Treated in the initial chapters are the obvious luminaries: Adams, Jefferson, Hamilton, Madison, Marshall, Roane, Story, Kent, and Wythe who adapted English and Colonial law to America's needs. Cited for special recognition in the era just before and after the Civil War are Taney, Curtis, Bingham, Cooley, and Field. Schwartz credits Holmes who more than anyone "set the theme for modern American law." He concludes with an analysis of pragmatic instrumentalism and of the current state of the law which he terms fragmented jurisprudence. Critical of the status of the late 20th century legal climate, he suggests that a "law without values has become the secular reflection of present day society." He closes, however, on a note of optimism, indicating that sooner or later the body politic and its legal institutions will be restored. Lacking in the literary flourishes that characterize Parrington's work, Schwartz's book, nevertheless, is a worthy and welcome addition to the literature of American law. Careful documentation; comprehensive index. Highly recommended for all informed readers. R. J. Steamer; emeritus, University of Massachusetts at Boston
