Kerwin examines rulemaking as a relatively unfamiliar yet vital aspect of lawmaking. He uses examples, such as the EPA's implementation of the Clean Air Act, to illustrate this important stage in the policymaking process, including basic rulemaking procedures and judicial consideration of rules.

CHOICE Review

Kerwin delivers a somewhat dry but informative text on the mechanisms and machinations of federal rule making. Most texts on American government focus overwhelmingly on the congress, presidency, and court while glossing over the two million individuals composing the federal bureaucracy. Yet, as Kerwin points out, bureaucrats often have the final say in turning vaguely worded congressional or presidential mandates into actual policies through rule making. Kerwin provides an excellent first chapter on the nature, history, and substance of rule making. Subsequent chapters, although bogged down a bit in the technical aspects of the process, examine how rules are made and who influences their formulation and enforcement. Use of good examples (i.e., the Clean Air Act, Medicaid) helps to illuminate the rules process. While lacking the emotive power of works like William Greider's classic chapter on Citizen G.E. in Who Will Tell The People (1992), the text demonstrates how powerful interests can win in the rule making process what they cannot in the electoral and legislative process.
