| Summary, etc. | La lectura de esta obra reafirma mi convicción de que debemos tener como norte la protección de los derechos individuales, por encima de consideraciones o intereses gubernamentales. Las Constituciones son creadas para reconocer las garantías individuales y satisfacer las necesidades de las personas frente al Estado, no a la inversa. Tal como discute el autor y lo fundamenta con jurisprudencia del Tribunal Supremo de los Estados Unidos, es imprescindible el rol judicial como garante de los derechos individuales, aunque ello haga más pesada la función del Ministerio Público. Al momento de contextualizar ese pronunciamiento, ese Foro Judicial ha acudido a la realidad social del presente y ha analizado elementos claves de la administración de la justicia, tal como nos expone el autor en la discusión del desarrollo del derecho bajo estudio. Es decir, no basta limitarse a mirar la norma constitucional. En ese sentido, opino que el Decano Fontanet Maldonado probó su caso de contextualizar la mirada profunda al derecho a la confrontación. |
